Definitions

In these terms and conditions, the 'Company' or 'Fairmont' will mean Fairmont Corporation Limited and the 'Customer' will mean any person, firm, company, corporation or body which places an order with the Company.

 

Sales

All sales are subject to our final confirmation. All orders received verbally, by fax or electronic mail are considered final. No cancellations will be accepted. Prices are subject to change without notice. All wines are offered subject to remaining unsold. Unless stated otherwise, all wines are offered lying in Hong Kong with the exception of en primeur. All goods sold are strictly non-exchangeable and non-refundable. This current list cancels all previous lists.

By placing an order, the Customer confirms that he/she is 18 years old or over. It is illegal to sell alcohol to people under the age of 18.


Wine Conditions

Ullages of all wines offered are top shoulder or better, unless otherwise stated. Although we strive to find wines in their best condition, the Customer must make appropriate allowances for natural variations of ullages, conditions of cases, labels and corks for old wines. We do not accept return wines for any reason, including corked wines.


Payment

Payment is due immediately upon receipt of invoice, except for approved trade account. Method of payment may be in the form of HKD check or by bank transfer. Please allow 3 working days for payment to clear before goods may be released. No credit or debit cards will be accepted

In the event of non-payment of an invoice within the specified terms stated above, Fairmont reserves the right to charge an interest of 3% per month of the overdue amount until payment. If the Company shall have to consult solicitors or other agents to recover overdue sums, the Customer will indemnify the Company in relation to reasonable fees payable to such solicitors and/or agents.


Title

Delivery/Collection

Fairmont offers a free delivery service to any address on the Hong Kong Island, Kowloon and the New Territories for purchases over HK$2,000. For delivery to the outlying islands, please consult us. For orders below HK$2,000, delivery charges are as follow:
HK Island: HK$10 per bottle (minimum $60)
Kowloon: HK$15 per bottle (minimum $100)
NT: HK$20 per bottle (minimum $150)

Please note that no wines are stored at our office. But under special circumstances and with 48 hours prior arrangement, wines may be collected at our office.


Breakages/Shortfall

All Customers are requested to examine the goods immediately upon collection or delivery for any deficiencies and/or damages. Claims (if any) must be logged at the time of delivery, otherwise any breakages or shortfall shall be deemed to have occurred thereafter.


Storage

Fairmont reserves the right to levy a storage charge of HK$20 per bottle per month for wines which have been made available but not collected or delivered within 30 days of purchase.

The charge will be yearly based at $180 per case (or part case) or per large format bottle. Cellarage invoices will be raised on 1 January each year for the full year. If wines are stored after the beginning of the year, charges will be calculated on a pro-rata basis. If you want to collect your wine early, we will refund you with the remaining full month(s) storage fee.


Force Majeure


Fairmont shall not be liable for any failure to meet our obligations occasioned by circumstances beyond our reasonable control.


Law and Jurisdiction


All sales and contracts are governed by the laws of Hong Kong SAR.
